Terms of Service

Welcome to Pulse. These Terms of Service (“Terms”) govern your access to and use of the Pulse mobile application, the pulserouter.com website, and related services (collectively, the “Service”), operated by Smokey Enterprises LLC (“Pulse,” “we,” “us,” or “our”).
By creating an account, purchasing or claiming a Pulse object, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use Pulse. If you are under 18, you represent that you have your parent or guardian’s permission to use the Service. By using Pulse, you represent that you meet these requirements.
2. The Service
Pulse provides NFC-enabled physical objects (rings, bracelets, cards, and similar items, referred to as “Pulse Objects”) that, when tapped against a compatible device, direct the recipient to content you configure within the app — including individual links (“Modes”) and collections of links (“Profiles”). Pulse also allows recipients to save content for later retrieval, and provides account, referral, and analytics features described within the app.
We may add, change, or remove features of the Service at any time, with or without notice.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information when creating an account and to keep it up to date. You are responsible for any content, links, or configurations you associate with your account and Pulse Objects.
You may sign in using Apple, Google, or email-based authentication. You are responsible for securing access to whichever method you use.
4. Pulse Objects
4.1 Claiming. Pulse Objects must be claimed through the app to become associated with your account. An unclaimed Pulse Object has no association with any user account and will not route to any content until claimed.
4.2 Ownership and Digital Identity. Purchasing a Pulse Object gives you ownership of the physical item. Objects may be organized into numbered batches or generations, each with an associated digital record maintained by Pulse. This digital record reflects the object’s batch, claim status, and configuration history, but does not constitute a security, financial instrument, or investment product. Pulse makes no representation that any Pulse Object will increase in value, and you should not acquire a Pulse Object with an expectation of profit.
4.3 Transfer. If you transfer physical possession of a claimed Pulse Object to another person, you are responsible for unclaiming or reconfiguring it as appropriate. Pulse is not responsible for content delivered by an object that was transferred without being unclaimed or updated.
4.4 Loss or Damage. Pulse is not liable for the loss, theft, or damage of a physical Pulse Object. If a Pulse Object is lost or stolen, you may be able to lock its associated account access or reconfigure your linked content through the app, but Pulse cannot prevent someone in physical possession of an unclaimed or improperly secured object from having it interact with compatible devices.
4.5 Physical Product Safety. Pulse Objects worn on the body (such as rings and bracelets) are made from materials described at the time of purchase. If you have known metal allergies or sensitivities, review the product’s material composition before use and discontinue use if irritation occurs. Pulse Objects are not intended for children under 3 years of age and may present a choking hazard due to small parts. Consult a physician if you experience any adverse reaction to a Pulse Object.
5. User Content
5.1 Your Content. “User Content” includes any links, labels, images (including custom uploaded logos), profile information, and other material you add to your account, Modes, or Profiles. You retain ownership of your User Content, but grant Pulse a worldwide, non-exclusive, royalty-free license to host, store, display, and transmit it as necessary to operate the Service, including delivering it to recipients who tap or save your Pulse Objects or shared links.
5.2 Your Responsibilities. You are solely responsible for your User Content and the destinations you link to. You represent that you have the necessary rights to any content you upload, including custom images, and that your User Content does not:
- Infringe any third party’s intellectual property, privacy, or other rights;
- Impersonate any person or entity, or misrepresent your affiliation with any person, company, or brand;
- Contain unlawful, fraudulent, deceptive, defamatory, obscene, or otherwise objectionable material;
- Link to malware, phishing pages, or other harmful destinations;
- Violate any applicable law or regulation.
5.3 Custom Images. If Pulse permits you to upload a custom image for a Mode or Profile, you represent that you own the rights to that image or have permission to use it, and that it does not depict content prohibited under Section 5.2. Pulse reserves the right to remove any custom image and to suspend the associated account at its discretion.
5.4 Reporting. Pulse provides mechanisms to report User Content that you believe violates these Terms. We review reports at our discretion and are not obligated to take any specific action, though we may remove content, suspend accounts, or take other steps we deem appropriate.
6. Prohibited Conduct
In addition to the restrictions in Section 5, you agree not to:
- Use the Service for any illegal purpose;
- Attempt to gain unauthorized access to any account, Pulse Object, or portion of the Service not intended for you;
- Reverse engineer, decompile, or attempt to extract the source code of the Service, except as permitted by law;
- Interfere with or disrupt the integrity or performance of the Service;
- Use automated means (bots, scrapers, etc.) to access the Service without our prior written consent;
- Circumvent, disable, or otherwise interfere with security features of the Service;
- Resell or commercially exploit the Service or Pulse Objects without our authorization, except in the ordinary transfer of a physical object you own.
7. Referrals and Incentive Programs
Pulse may offer referral programs, unlocks, or other incentives (such as analytics access) tied to inviting others to use the Service. These programs are offered at Pulse’s discretion, may change or end at any time, and are subject to any additional terms presented within the app. We reserve the right to deny, revoke, or claw back incentives obtained through fraud, abuse, or violation of these Terms.
8. Third-Party Links and Services
The Service may direct users to third-party websites, apps, or services (for example, a Venmo, Instagram, or other Mode destination you configure) that are not owned or controlled by Pulse. We are not responsible for the content, privacy practices, or terms of any third-party destination. Your interactions with third parties linked through the Service are solely between you and that third party.
9. Intellectual Property
The Service, including its design, software, trademarks, and branding (excluding User Content), is owned by Smokey Enterprises LLC and protected by applicable intellectual property laws. Except as expressly permitted in these Terms, you may not copy, modify, distribute, sell, or lease any part of the Service.
10. Termination
You may stop using the Service and delete your account at any time through the app or by contacting us. We may suspend or terminate your account or access to the Service at our discretion, with or without notice, including for violation of these Terms. Upon termination, your right to use the Service ceases, though these Terms will continue to apply to your prior use.
11. Disclaimers
THE SERVICE AND PULSE OBJECTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY PULSE OBJECT WILL FUNCTION WITH EVERY DEVICE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PULSE AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR PULSE OBJECTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO PULSE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
13. Dispute Resolution and Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved through binding individual arbitration, rather than in court, except that either party may bring an individual claim in small claims court where jurisdictionally appropriate. YOU AND PULSE EACH WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE ACTION. This section does not prevent either party from seeking injunctive relief for intellectual property infringement or unauthorized access to the Service.
14. Indemnification
You agree to indemnify and hold harmless Pulse and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your User Content, or your violation of these Terms.
15. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice through the app or by other reasonable means. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. The “Last updated” date at the top of this page reflects the most recent revision.
16. Governing Law
These Terms are governed by the laws of the State of Utah, without regard to its conflict of law principles, unless otherwise required by applicable law in your jurisdiction.
